WAIANAE, Hawaii (KHON2) -- A man who shot his neighbor that drove a frontloader into his home will not be charged, police records show.
The incident happened on Aug. 31 during a party where family members were in the carport when the neighbor reportedly used the frontloader to ram multiple cars into the home and opened fire.
Five people were shot before a 42-year-old male resident of the home retrieved a handgun and shot and killed the neighbor.
The 42-year-old was arrested and held for a short time before being released pending investigation.
Cherell Keamo, Courtney Raymond-Arakaki and Jessyca Amasiu all died from their injuries.
The neighbor was identified as Hiram Silva.
The case was forwarded to the prosecutorʻs office and on Sept. 18 "was declined due to issues related to self-defense and defense of others."
"In Hawaii, a person is allowed to use proportional amounts of force to defend themselves," said defense attorney Victor Bakke shortly after the incident.
