98 days of testimony: Miske trial nears the end

HONOLULU (KHON2) -- On the 98th day of trial, the federal conspiracy and racketeering trail of accused crime boss Mike Miske is nearing the end as prosecutors presented their closing arguments.

After a week break, the 16-person jury returned on Thursday and listened as the government attempted to summarize nearly 100 days of testimony.

Since the trial began in January, 241 witnesses were called by the prosecution and more than 1,300 exhibits were presented.

The government called Miske the "epicenter" of a "criminal underworld" who embodied "intimidation, retribution and violence" to build and maintain a criminal enterprise that preyed upon society for the better part of two decades.

Prosecutors said of all the criminal charges against him, Miske's greatest weapon was "money and the power and influence that it brought."

The prosecution spent time reviewing the testimony and evidence in the 16 counts against Miske including conspiracy, along with the 14 additional racketeering acts that include murder and attempted murder.

Out court analyst told KHON2 it's an important tactic for federal prosecutors who only need to get the jury to find Miske guilty of at least one count of conspiracy for a higher sentence.

"In a conspiracy, all the government has to do is prove to the jury that two or more people agreed to commit a crime. They don't even have to prove the crime was carried out or successful. They just have to approve prove there was an agreement to commit the crime," said former federal attorney, Alexander Silvert.

Prosecutors also spent a considerable amount of time walking the jury through the days up to Jonathan Fraser's disappearance in July 2017.

Miske is accused of ordering the murder of Fraser, although his body has never been found.

The defense is scheduled to present its closing arguments on Friday.
